1. Introduction and effectiveness of the General Terms and Conditions<\/strong>
These general terms and conditions of sale (hereinafter, the \u201cGeneral Terms and Conditions\u201d) govern the purchase of products and services made remotely and made available via the internet on the website www.longospeciality.it (hereinafter the \u201cWebsite\u201d) in accordance with Italian legislation as set out in Legislative Decree 206\/2005, as amended and supplemented (hereinafter the \u201cConsumer Code\u201d), and the legislation governing e-commerce.<\/p>

The seller of the products and owner of the Website is Longo un Mondo di Specialit\u00e0 Srl, with its registered office at Corso Italia, 43 \u2013 Legano (MI), Tax Code\/VAT No. 11667830159 and registered with the Milan Companies Register under REA No. 1488127. Email address: longo@longospeciality.it (hereinafter \u201cLongospeciality\u201d).<\/p>

Any consumer accessing the Website to make purchases (hereinafter the \u201cCustomer\u201d) is required, before placing an order, to read these General Terms and Conditions carefully; these have been made available to them on the Website and may be consulted at any time.<\/p>

In the event that a person making purchases on the Website requests an invoice and\/or is not a \u201cconsumer or user\u201d as defined by the Consumer Code, the provisions which, under the same Consumer Code, apply exclusively to consumers \u2013 including the rules governing the right of withdrawal \u2013 shall not apply, unless otherwise provided for by mandatory law.<\/p>

For corporate orders, bespoke supplies, requests for large quantities, custom packaging, the incorporation of materials supplied by the Customer, graphic customisation, multiple shipments or specific commercial terms, specific terms and conditions of sale communicated by Longo at the time of the offer, quotation or order confirmation may apply. In such cases, the special terms set out in the offer or quotation accepted by the Customer shall, where incompatible, take precedence over these General Terms and Conditions of Online Sale.<\/p>

Purchases made with Longo via the Website are governed by these General Terms and Conditions and by Italian law.<\/p>

2. Choosing and Ordering Products<\/strong>
The main features and prices of the products for sale on the Website, hereinafter referred to as the \u201cProduct\u201d or \u201cProducts\u201d, are set out on the page for each Product.\u00a0<\/span>To purchase the Products, the Customer must complete and submit the order form electronically, following the instructions on the Website.\u00a0<\/span>The Customer must add the Product to their basket and, after reading these General Terms and Conditions and the Privacy Policy, must enter their delivery and, where applicable, billing details, select their preferred payment method and confirm the order.<\/span><\/p>

By placing an order via the Website, the Customer confirms that they have read all the information provided during the purchase process and that they fully accept these General Terms and Conditions and the payment terms.<\/p>

The contract between Longo and the Customer is deemed to have been concluded upon Longo\u2019s acceptance of the order. This acceptance is communicated to the Customer via a confirmation email containing the order number, delivery and billing details, the list of Products ordered, the total price, any delivery charges and a reference to these General Terms and Conditions.<\/p>

The Customer is required to carefully check the email from\u00a0Order confirmation. Should you spot any errors in the details you have entered or in the order\u00a0<\/span>Once this has been carried out, you must contact Customer Services as soon as possible and, in any event,\u00a0<\/span>within 12 hours of receiving the confirmation email. Once this period has elapsed,\u00a0<\/span>the order may be processed, and it will not always be possible\u00a0<\/span>to ensure that amendments are made, without prejudice to the rights granted to the Customer under the\u00a0<\/span>applicable legislation.<\/span><\/p>

Once the order has been received, Longo will check the availability of the Products ordered. Should one or more Products not
Should they become available, Longo will inform the Customer promptly by email.\u00a0In the event that one or more Products are unavailable, Longo may, where possible, offer the Customer:<\/span><\/p>

  • replacement with products of equal or greater value and quality;<\/li>
  • the dispatch of available Products only;<\/li>
  • the total or partial cancellation of the order;<\/li>
  • a refund of the amount relating to the unavailable Products.<\/li><\/ul>

    For gift packs or assortments comprising several products, Longo reserves the right to substitute any products that are not
    available with other items of equal or greater value and quality, whilst ensuring that the nature, quality and positioning of the packaging remain as consistent as possible. In the case of consumer customers, any significant substitutions will be communicated before the order is processed and handled in accordance with the rights recognised by the applicable legislation.<\/p>

    Longo shall not be liable for any delays, failed deliveries or additional costs arising from inaccurate, incomplete or incorrect information provided by the Customer, including addresses, postcodes, names, telephone numbers, delivery details and billing information.<\/p>

    Once the order has been received, Longospeciality will check stock availability in order to fulfil the order. Should one or more Products prove to be unavailable, Longospeciality\u2019s Customer Service team will promptly notify the Customer by email; the Customer will then have 12 hours to reply, either to confirm dispatch of any additional available Products or to cancel the order. If no reply is received within this timeframe, the order will be deemed confirmed and the available products will be dispatched. If only a few Products are out of stock, Longospeciality will fulfil the order with the available Products. In both cases, the amount relating to the missing Products will be refunded immediately, depending on the chosen payment method.<\/span><\/p><\/div>

    3. Product Information<\/strong>
    Information and specifications relating to the Products are available in the relevant product descriptions on the Website.<\/span>\u00a0<\/span>For food products, Longo provides the mandatory information required by the applicable legislation, including, where
    Relevant information: name of the food, list of ingredients, allergens, net quantity, storage conditions, details of the responsible operator, country of origin where required, alcohol content for alcoholic drinks, and any further information required by current legislation.<\/span><\/p>

    Customers are advised to read the information on the product page carefully before making a purchase, paying particular attention to the presence of allergens, storage instructions and the characteristics of the food products.<\/p>

    The visual representation of the Products on the Website, where available, normally corresponds to the photograph or illustration accompanying the product description. It is understood that the images of the Products and their packaging are intended solely to present them for sale and may not be entirely representative of their final characteristics, as they may differ in colour, size, internal layout, packaging or aesthetic details.\u00a0In the event of any discrepancy between the image and the written product description, the textual description on the product page shall always take precedence.<\/span><\/p>

    4. Prices and Shipping<\/strong>
    All prices published on the Website are quoted in euros and include VAT, unless otherwise expressly stated.<\/p>

    Delivery charges, where applicable, are shown in the shopping basket and summarised before the order is finally confirmed. Any additional costs will always be communicated to the Customer before the purchase is finalised.<\/p>

    Longo reserves the right to change the prices of its products and the delivery terms at any time. Any changes will not
    will affect orders that have already been confirmed.<\/p>

    For deliveries within Italy, the applicable rates are calculated based on the number of parcels, weight, volume, and
    destination and the terms and conditions applicable at the time of ordering. The relevant amount will be shown to the Customer before the purchase is confirmed.<\/p>

    For international shipments, for quantities exceeding those that can be processed automatically via the Website, or for destinations not available at checkout, the Customer may request a personalised quote. Once the shipping terms have been agreed with Longo, the Customer may proceed in accordance with the instructions provided by Customer Services.<\/p>

    For requests involving large quantities, multiple deliveries, door-to-door deliveries, deliveries by appointment, deliveries to specific floors, specialised logistics services or deliveries on strict deadlines, Longo can provide a bespoke quotation.<\/p>

    In the case of promotions, discounts or promotional codes, the relevant terms and conditions will be set out on the Website or in the relevant marketing communication. Any announcements of price reductions will be handled in accordance with current legislation.<\/p>

    5. Payment and Invoicing<\/strong>
    The Customer may pay for the order using the payment methods available on the Website at the time of purchase.\u00a0<\/span>If, due to specific quantities or conditions, it is not possible to process the order automatically, the Customer may request, via the Website, to be contacted directly by a Longo sales representative.<\/span><\/p>

    Longo advises against leaving items in your basket or in unconfirmed orders for long periods, as the products
    may no longer be available by the time you confirm your purchase.<\/p>

    5.1 Payment Methods<\/strong>
    The Customer may pay for the Products and the associated delivery charges by credit card, PayPal or bank transfer.\u00a0<\/span>The payment methods accepted on the Website include Visa, Visa Electron and Mastercard<\/span>.<\/span><\/p>

    To ensure maximum security, the Customer will complete the payment transaction directly on the secure server of the payment provider or the relevant credit institution. The Website does not store the Customer\u2019s full credit card number.<\/p>

    In the case of payment via PayPal, once the order has been confirmed, the Customer will be redirected to the PayPal website, where they can make the payment using their PayPal account or a card \u2013 including a prepaid card \u2013 in accordance with the methods accepted by PayPal and subject to the relevant terms and conditions.<\/p>

    5.2 Invoicing of Orders<\/strong>
    <\/strong>If the purchase is made by a business, you may request an invoice by ticking the relevant box during the ordering process and correctly entering all the necessary details, including company name, address, tax code and\/or VAT number, recipient code and\/or certified email address.<\/p>

    The Customer is responsible for ensuring that billing details are entered correctly.<\/p>

    When placing an order, the Customer must carefully check that the tax details are correct and notify us of any specific administrative requirements. If an invoice is not requested at the time of ordering, or if the tax details are incomplete or incorrect, Longo may not be able to issue or amend the tax document at a later date.<\/p>

    Any requests to amend billing details after the tax document has been issued may not be accepted or may result in additional administrative processing time.<\/p>

    6. Transport and delivery<\/strong>
    Products purchased on the Website will be delivered to the address provided by the Customer during the checkout process in the \u201cDelivery details\u201d field.<\/p>

    Delivery times may vary depending on the availability of the Products, the size of the order, the destination, the time of year and any seasonal peaks or logistical difficulties. The delivery times indicated on the Website or communicated by Customer Services are to be regarded as indicative, unless otherwise agreed in writing.<\/p>

    Longo uses qualified carriers to dispatch its Products. Any delays attributable to the carrier, force majeure, incorrect addresses, recipients being absent or incomplete information provided by the Customer shall not be attributed to Longo, without prejudice to the mandatory rights granted to the Consumer Customer.<\/p>

    In the event of an incorrect or incomplete address, the recipient being absent, refusal of delivery, the recipient being unreachable or incorrect delivery details, any costs relating to storage, redelivery, release from customs or handling may be charged to the Customer.<\/p>

    Customers are asked to provide a full and manned delivery address, including any information that may be useful to the courier.<\/p>

    Upon delivery, the Customer is asked to check that the number of packages matches that stated in the dispatch documentation and that the packaging is intact, undamaged, dry and has not been tampered with in any way.<\/p>

    In the event of visible damage, missing items or packaging defects, the Customer is asked to accept the delivery subject to specific reservation, clearly stating the nature of the defect found, and to contact Customer Services without delay.<\/p>

    Unqualified acceptance may make it more difficult to deal with any claims relating to damage caused during transport, without prejudice to the protection provided for under the applicable legislation.<\/p>

    7. The Consumer Customer\u2019s right of withdrawal<\/strong>
    The Consumer Customer is entitled to withdraw from the contract, without having to give any reason, within 14 days of the date on which they receive the Product. In the case of an order comprising several Products delivered separately, the period begins on the day on which the Consumer Customer receives the last Product.<\/p>

    To exercise the right of withdrawal, the Consumer Customer must notify Longo of their decision by means of an explicit statement, sent by email to info@longospeciality.it. The notification must include at least:\u00a0<\/p>

    • the Customer\u2019s first name and surname;<\/li>
    • order number;<\/li>
    • Product or products in respect of which you wish to exercise your right of withdrawal;<\/li>
    • email address and telephone number;<\/li>
    • any details required for a refund, if necessary.<\/li><\/ul>

      Once notice of withdrawal has been given, the Consumer Customer must return the Products without undue delay and, in any event, within 14 days of giving notice of withdrawal, in accordance with the instructions provided by Longo. The direct costs of returning the Products shall be borne by the Consumer Customer, unless otherwise specified by Longo.<\/p>

      The refund will be issued within 14 days of the date on which Longo was informed of the Consumer Customer\u2019s decision to withdraw. Longo may withhold the refund until it has received the Products or until the Customer has provided proof that they have been returned, whichever is earlier. The refund will be made using the same payment method used by the Customer for the purchase, unless otherwise agreed.<\/p>

      8. Exclusions and limitations on the right of withdrawal<\/strong>
      The right of withdrawal does not apply in the cases provided for by current legislation. In particular, by way of example, the right of withdrawal may be excluded in the following cases:<\/p>

      • Products made to measure or clearly personalised;<\/li>
      • Foodstuffs or goods that are likely to spoil or go off quickly;<\/li>
      • Sealed products which cannot be returned for hygiene or health protection reasons and which have been opened after delivery;<\/li>
      • personalised gift sets, made to the customer\u2019s specific requirements;<\/li>
      • Products or materials featuring logos, text, graphics, cards, packaging or other elements supplied or approved by the Customer.<\/li><\/ul>

        Customers are advised to check carefully, before making a purchase, whether the chosen Product is one for which the right of withdrawal is excluded or restricted. This is without prejudice to the Customer\u2019s rights in the event of a defective, damaged or non-compliant Product.<\/p>

        Returned products must be undamaged, complete, unused, properly stored and returned in their original packaging, where possible. In the case of food, drink and gift packs, Longo reserves the right to verify that the products have been stored and returned in a condition appropriate to their nature.<\/p>

        9. Warranty and Conformity Defects<\/strong>
        In the event of any lack of conformity in the Products sold by Longo, the Customer must contact Customer Services using the dedicated contact form available on the Website via the \u201cContact Us\u201d tab, by calling +39 334 6968749 or by emailing assistenza@longospeciality.it.<\/p>

        The statutory guarantee of conformity provided for in the Consumer Code applies to the sale of Products to Consumer Customers.<\/p>

        Longo is liable to the Consumer Customer for any lack of conformity existing at the time of delivery of the Product and which becomes apparent within the time limits laid down by law.\u00a0<\/p>

        In the event of a defective, damaged or non-compliant Product, the Customer is asked to contact Customer Services without delay, attaching, where possible:<\/p>

        • order number;<\/li>
        • a description of the problem encountered;<\/li>
        • photographs of the product, the packaging and the label, where relevant;<\/li>
        • a copy of the purchase documentation.<\/li><\/ul>

          Longo will assess the report and, where the conditions are met, will propose one of the remedies provided for under the applicable legislation, including replacement, restoration of conformity, a price reduction or a refund.<\/p>

          For food products, the Customer must follow the storage instructions given on the label or in the product information sheet. Longo accepts no liability for any spoilage resulting from improper storage, exposure to heat sources, failure to follow the instructions provided, or use that is not in accordance with the nature of the Product.<\/p>

          10. Errors and limitations of liability<\/strong>
          <\/strong>The information relating to the Products provided via the Website is constantly updated. However, we cannot guarantee that it is entirely free from errors, inaccuracies or omissions. Longo reserves the right to correct any errors, inaccuracies or omissions, even after an order has been placed, or to amend or update the information on the Website at any time, without prejudice to the Customer\u2019s rights under these General Terms and Conditions and applicable legislation.<\/p>

          Except in cases of wilful misconduct or gross negligence, and without prejudice to the mandatory rights granted to the Consumer Customer, Longo shall not be held liable for any damages arising from the non-acceptance or non-fulfilment, even partial, of an order; delays not attributable to Longo; force majeure; the unavailability of Products; supply difficulties; or service disruptions attributable to third parties.<\/p>

          For Business Customers, except in cases of wilful misconduct or gross negligence, Longo\u2019s total liability shall be limited to the value of the supply in question, excluding indirect damages, loss of profit, loss of customers, reputational damage or other consequential damages.<\/p>

          Longo promotes the responsible consumption of alcoholic beverages. The sale of alcoholic beverages is prohibited to persons under the age of 18. By placing an order containing alcoholic beverages, the Customer declares that they are of legal age and that they are providing accurate details. Longo reserves the right to cancel orders if evidence emerges to suggest that the purchase is being made by a minor or on behalf of a minor.<\/p>

          Longo may implement age verification procedures at the time of purchase or delivery, including through the designated carrier, where technically feasible or required by applicable legislation.<\/p>

          11. Complaints<\/strong>
          <\/strong>Any complaints must be submitted to Longo using the dedicated contact form, which can be accessed directly on the Website via the \u201cContact\u201d tab, by telephoning +39 334 6968749, which is available from Monday to Friday from 8.30 am to 12.30 pm and from 2.00 pm to 6.00 pm, excluding public holidays, or by email to assistenza@longospeciality.it.\u00a0<\/p>

          Longo is committed to processing all enquiries received as quickly as possible and, as a general guide, within a maximum of 7 working days.<\/p>

          To ensure your enquiry is dealt with more quickly, please always quote your order number and provide all the information needed to assess your complaint.<\/p>

          12. Alternative dispute resolution<\/strong>
          Consumer Customers may make use of any alternative dispute resolution mechanisms provided for under the applicable legislation.<\/p>

          The previous European ODR platform for online dispute resolution was discontinued with effect from 20 July 2025. Any references to the ODR platform are therefore no longer applicable.<\/p>

          13. Governing law and jurisdiction<\/strong>
          The contract of sale between the Customer and Longo is deemed to have been concluded in Italy and is governed by Italian law.<\/p>

          In the event of any dispute arising out of the interpretation, performance or termination of these General Terms and Conditions or of individual purchase orders:<\/p>

          • if the Customer is a consumer within the meaning of the Consumer Code, the court with jurisdiction shall be that of their municipality of residence or domicile, provided that this is located within Italian territory;<\/li>
          • In all other cases, the Court of Milan shall have exclusive jurisdiction, to the exclusion of any other court.<\/li><\/ul>

            \u00a0<\/p>

            14. Specific approval for Professional Clients<\/strong>
            Pursuant to and for the purposes of Articles 1341 and 1342 of the Italian Civil Code, the Professional Customer declares that they have read and specifically accept the following articles of these General Terms and Conditions:<\/p>

            • Art. 2 \u2013 Selecting and ordering Products, with particular regard to availability, substitutions and liability for inaccurate or incomplete information provided by the Customer;<\/li>
            • Art. 4 \u2013 Prices and delivery, with particular reference to bespoke quotations and specialised logistics services;<\/li>
            • Art. 5 \u2013 Payment and invoicing procedures;<\/li>
            • Art. 6 \u2013 Transport and delivery, with particular reference to delays, goods held in storage, redeliveries and liability for incorrect delivery details;<\/li>
            • Art. 8 \u2013 Exclusions and limitations on the right of withdrawal;<\/li>
            • Art. 10 \u2013 Errors and limitations of liability;<\/li>
